By accessing and using dafdev.com or any of our services, you accept and agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, please do not use our services.

2. Services

Daf-Devs provides:

• AI automation and development services
• Cybersecurity consulting and penetration testing
• Web and mobile application development
• Cloud solutions and DevOps services
• API development and integration
• SaaS products and software solutions

3. User Obligations

You agree to:

• Provide accurate and complete information when using our services
• Maintain the confidentiality of any account credentials
• Use our services only for lawful purposes
• Not interfere with or disrupt our services
• Not attempt to gain unauthorized access to our systems
• Comply with all applicable laws and regulations

4. Intellectual Property

All content, features, and functionality on our website are owned by Daf-Devs and protected by international copyright, trademark, and other intellectual property laws.

For custom development projects:

• Clients own the final deliverables upon full payment
• Daf-Devs retains rights to reusable code components and frameworks
• Source code ownership is defined in project contracts
• We may showcase completed projects in our portfolio (with client approval)

5. Payment Terms

Payment terms vary by service type:

• Fixed-Price Projects: Milestone-based payments (typically 30% upfront, 40% mid-project, 30% completion)
• Monthly Retainers: Invoiced monthly in advance
• Hourly Consulting: Invoiced bi-weekly
• SaaS Products: Subscription-based billing (monthly or annual)

Payment is due within 14 days of invoice date. Late payments may incur a 2% monthly fee.

6. Refund Policy

Refunds are handled as follows:

• Service Projects: Refunds available if project scope is not met (evaluated case-by-case)
• SaaS Products: 30-day money-back guarantee for first-time subscribers
• Consulting: Refundable for unused hours with 7-day notice

7. Confidentiality

We sign Non-Disclosure Agreements (NDAs) for all client projects. All client information, business processes, and proprietary data are kept strictly confidential. Our team members are bound by confidentiality agreements.

8. Warranties and Disclaimers

Warranties:

• We warrant that services will be performed professionally and competently
• 30-day post-launch bug fix guarantee for development projects
• Services will substantially conform to agreed specifications

Disclaimers:

Services are provided "as is" without warranty of any kind beyond those explicitly stated. We do not guarantee uninterrupted or error-free operation. Results may vary based on client cooperation and external factors.

9. Limitation of Liability

To the maximum extent permitted by law, Daf-Devs shall not be liable for any indirect, incidental, special, consequential, or punitive damages. Our total liability for any claim shall not exceed the amount paid by the client for the specific service in question.

10. Termination

Either party may terminate services:

• By Client: With 30-day written notice for ongoing services
• By Daf-Devs: Immediately if client breaches terms or fails to pay
• Upon termination, client pays for work completed to date
• Deliverables provided for paid milestones become client property

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales (for UK clients) or the laws of Kenya (for Kenya-based clients), without regard to conflict of law provisions.

12. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be notified via email or website notice. Continued use of services after changes constitutes acceptance of modified terms.
